A NJ bill about online forums

Details in the link, I don't know much about who or what this will affect or what it will affect but, I really wouldn't want people running around the net filing frivelious suits on online forums cause of certain things. Just giving you guys the heads up. And, I suggest taking this one seriously.

After clearing my head today, I have a better understanding.

This bill if passed in the New Jersey legislature, states that in the event there are any defamatory remarks on a forum concerning a citizen of New Jersey, a native of that state can issue a law suit toward the offending individual.

Sorry about the earlier post, I was juggling too many things.

Edit: Damn, I keep forgetting to say things. And, it also pertains to the administrator of the site, I know the administrator here is in Europe but, I'm sure there are also administrators of other sites here as moderators. That's why, I posted this.

Thanks Sean. MishY, I think we can stop banning New Jersey residents.

*EDIT* Sorry I didnt post the link from the above quote http://en.wikipedia.org/wiki/Peter_J._Biondi (looks like an older version of my ex-husband and I'll bet he is anal retentive too, oops does he live in New Jersey)

"Internet service provider" or "provider" means any person, business or organization qualified to do business in this State that provides individuals, corporations, or other entities with the ability to connect to the Internet through equipment that is located in this State.
Thanks for your concern though Jéré. It is appreciated.

" with the ability to connect to the Internet through equipment that is located in this State."
was added in the 2nd revision I'm sure once the NJ legislature were accurately informed that the law would be unenforceable on servers located anywhere else.

Assemblyman Biondi has introduced a bill in the 2006 legislative session which would require operators of all "public forum websites" to gather the full names and addresses of all persons posting on said websites, and turn said information over to anyone claiming the posting of "false or defamatory information"
So how the heck are they going to ensure that they have the right person?

I could post a message on a board, say my name is George Bush, use some anonymiser and even spoof the white house IP address.

Correct.

Thing is there can be candidates for enforcing it to people, if the offended individual can find that person, it's rare but, it can work.

I think it'll get repealed under the 1st amendment then revised to coincide with the 1st amendment. If you got a few New Jersey native users, be aware of that case if the bill is passed if it's not i'd still keep an eye on it till it expires or, whatever happens to unused bills.

It does but, it can be revised to coincide with the amendments. Freedom of speech doesn't mean you can walk anywhere and say whatever the hell you want, you do need a permit to perform a protest. Thing is with this bill is it wants to get rid of unpeaceful forums that harm more then do good. If it passed, I didn't want people here getting caught in the crossfire.
