I have formatted the laptop sevaral times and have updated all drivers. There are virtually no programs other than those installed by the manufacturer. I have sent the PC to the manufacturer, however they, returned it stating that no hardware issues have been found.

I was wondering if this is a hardware or software issue ?
What is the problem and how can it be fixed ?

Can be triggered by a myriad of different issues, but most commonly by bad RAM or a hard drive that's starting to fail (despite you being told the hardware is all okay, you still need to confirm that's true, as even laptop manufacturer's can be wrong).
Test the RAM with Memtest86 (requires a CD to be made from the downloaded ISO CD-image file, then you boot your PC from that CD): http://www.memtest.org/

Test the hard drive with Seagate SeaTools (doesn't matter if it isn't a Seagate drive):

There's a Windows version which you install, or a DOS version which runs from a bootable CD (like Memtest86, you have to make the CD from the downloaded CD-image ISO file. If your Windows is running unstable or blue-screening, use the DOS version.

To create a CD from any ISO CD-image file you can do it with IMGBurn from here:
